PROPOSED AMENDING THE REGULATIONS ON LAND VALUATION METHODS

The Ministry of Natural Resources and Environment (MONRE) is drafting a circular amending and supplementing several regulations on land valuation methods; building and adjusting land price lists; specific land valuation and land price determination consultancy.

On the afternoon of June 14, a representative of the Ministry of Natural Resources and Environment said that the Governments Decree No. 44/2014/ND-CP dated May 15, 2014 (Decree 44) regulating land prices stated five methods of land valuation: comparison. the direct, deduction, collection, surplus, land price adjustment coefficient, and conditions for applying these 5 methods.

At the same time, Circular No. 36/2014/TT-BTNMT dated April 30, 2014, of the Ministry of Natural Resources and Environment (Circular 36) detailing methods of land valuation, order and procedures for building land price list, and land valuation. and advice on determining land prices. These are the legal basis for local land valuation since promulgation.

However, up to now, in the context of strong economic development, attracting many development investment projects, land valuation in some places has not been timely, and there is no mechanism and resources to collect revenue. Collecting full data and information on popular land prices in the market, ensuring that the valuation is consistent with the market price.

The application of land valuation methods in some localities has revealed limitations that need to be removed. Therefore, it is time to amend and supplement several articles of Circular 36 to promptly remove difficulties and obstacles in the land valuation process.

MONRE has drafted a circular to replace Circular 36, which amends and replaces several articles. Specifically, in Article 3, there will be specific provisions on the source of information collection on land prices of land plots compared with the winning land price at auction, the land price stated in the land use right transfer contract, and the market land price. field on the database of land.

In addition, removing regulations on successful trading in the market and collecting information through face-to-face interviews; specifying the scope of information collection in case the valuation area does not collect enough information. Based on the actual situation in their localities, provincial-level Peoples Committees shall specify the ratio table to adjust the different factors of the land plots compared with the land plot to be valued.

The Ministry of Natural Resources and Environment also proposes to amend and supplement Article 5 of Circular 36 in the direction of specifying the time to calculate the average 1-year income of the land plot to be valued for agricultural and non-agricultural land. ; Specific regulations for cases where information to determine the average income per year of the land plot to be valued does not fully reflect the annual income or accurately reflect the actual income from the use of land for the land. agricultural and non-agricultural…
